Sea View Holiday Apartments - Holiday rental terms and conditions
1.The Property is offered as a holiday let by Esme and Stephen Humpston (tel
01296 613215) the owners of Sea View Holiday Apartments trading as Old
County Developments.
2. An initial payment of £100* (unless otherwise stated) is payable in
order to confirm the booking within seven days of the reservation. The
balance to cover the rental agreement (Rent) must be paid 6 weeks prior
to occupation. * This £100 deposit will also be used as 'bail money as a
refundable security and cleaning deposit to cover excessive cleaning
costs and breakages. The refundable deposit will be returned within 2
weeks of the departure date (unless by prior agreement due to illness,
postal strike etc.)
We require a 3% charge for payment by credit card- there is no charge
for debit card, bank transfer or cheque payment
Refunded payments will be made by cheque unless original payment was by
credit card. If payment by credit card then the original card will be
refunded (except for payment made more than 180 days before the refund)
3. If the Client does not pay the balance of the Rent by the due date
the contract shall be deemed to be cancelled by the Client.
4. Should you wish to cancel your booking for any reason; all monies
paid will be refunded if the property can be re-let for the full period
of the booking. We reserve the right to charge a 5% administration fee
for cancellation.
We strongly advise clients to take out holiday insurance. Refunds for
unforeseen circumstances are otherwise at the discretion of Old County
Developments and we may require documentation to support a refund claim.
In the unlikely event that the Property becomes unavailable for your
date or changes are necessary to the booking, we undertake to notify you
as soon as reasonably possible and reserve the right to arrange
alternative accommodation. If it is not possible to arrange alternative
accommodation acceptable to yourselves we reserve the right to cancel
the booking and refund to you all monies paid to us.
Old County Developments will have no further obligations or liabilities
for non-availabilities, changes or cancellation.
5. The rent is VAT inclusive where applicable
6. Unless otherwise agreed the letting commences at 4.00 pm on the day
of arrival and ends at 12.00 pm on the day of departure.
7 The Client shall take reasonable and proper care of the Property and
its contents and leave them in the same state of repair and condition
and in the same clean and tidy condition at the end of the rental as at
the beginning, with all of the washing-up completed ensuring that the
key is returned in the self addressed jiffy bag provided. The Client
shall take reasonable measures with respect to the security of the
Property including locking doors and windows when they are out.
8. The Client should note that the property is an apartment within a
residential development and shall show consideration to neighbours in
respect of noise and care of the communal hallway. The Client shall
ensure that noise levels are reduced between 10pm and 8am within the
apartment, garden and communal areas to avoid nuisance to neighbouring
properties.
9. The Client shall not alter the property in any way.
10. The Client is liable to reimburse Old County Developments on demand
for the costs of replacement, repair or extra cleaning where they are in
breach of their obligations under 7 or any breakages or damage caused
during the period of occupation.
11. The Client shall be responsible for insuring their own possessions
whilst they are on or in the Property and for cancellation losses (see 4
above).
12. Old County Developments its employees and agents shall have no
liability to the Client or third parties for any loss or damage arising
from breaches of this contract, negligence, misrepresentation or
otherwise
13.The maximum occupancy permissible is 6. Numbers of occupants in
excess of this, (unless agreed in writing) subletting or sharing of the
property is not accepted in any circumstances. Violation of this clause
will result in immediate termination of your tenancy, and forfeiture of
all payments including breakages deposit.
14.The client will without delay report to the owner or to the owner's
representative any defects in the property or breakdown in the
equipment, plant, machinery or appliances in or on the property, and
arrangements will be made for repair or replacement as soon as
reasonably possible.
15. The client will not allow animals or pets to be brought in or on the
property, and will not allow any person to smoke in the apartment.
16. Old County Developments will not be liable to the client for any
loss damage or injury incurred at the property, or through use of any
equipment or facilities, other than death or personal injury arising as
a consequence of the negligence of the owner.
